A trading name of Turn Key Receptionist Pty Ltd (ABN 11 153 007 562) 
Effective Date: 1 March 2026

1. Agreement 

These Terms & Conditions (“Terms”) govern access to and use of the My Virtual AI platform (“Platform”), operated by Turn Key Receptionist Pty Ltd (ABN 11 153 007 562) (“Company”, “we”, “us”, “our”). 

By accessing or using the Platform, you (“Customer”) agree to be bound by these Terms. 

If you do not agree, you must not use the Platform. 

2. Nature of Service 

My Virtual AI is a Software-as-a-Service (SaaS) AI communication platform. 

Services may include (but are not limited to): 

  • Inbound AI call answering 

  • Call recording 

  • Call transcription 

  • Appointment booking 

  • Voice cloning 

  • Outbound dialling 

  • Outbound SMS 

  • Workflow automation 

  • Third-party integrations 

  • Future AI or communication features 

We provide access to technology only. 

We do not: 

  • Control Customer communications 

  • Monitor content 

  • Provide legal advice 

  • Act as agent or representative of the Customer 

3. Eligibility 

To use the Platform, Customer must: 

  • Be at least 18 years old 

  • Have authority to bind the business entity 

  • Provide accurate registration information 

Customer is responsible for all activity under their account. 

4. Regulatory & Legal Responsibility 

Customer is solely responsible for compliance with all applicable laws including but not limited to: 

  • Privacy Act 1988 (Cth) 

  • Australian Privacy Principles 

  • Telecommunications (Interception and Access) Act 1979 

  • State Surveillance Devices legislation 

  • Spam Act 2003 (Cth) 

  • Do Not Call Register Act 2006 (Cth) 

  • Australian Consumer Law 

  • Corporations Act (if applicable) 

  • Defamation laws 

  • Intellectual property laws 

We do not verify compliance. 

We do not monitor communications. 

Customer acknowledges that full regulatory responsibility rests with the Customer. 

 

5. Call Recording Compliance 

Where call recording is enabled: 

Customer is solely responsible for: 

  • Determining consent requirements 

  • Providing lawful notification 

  • Complying with interstate call laws 

  • Managing retention and deletion obligations 

We accept no liability for unlawful recording. 

Customer indemnifies us for any breach. 

6. Outbound Calling & SMS Compliance 

If Customer uses outbound dialling or SMS features, Customer warrants that: 

  • They have lawful consent to contact recipients 

  • They have checked the Do Not Call Register 

  • They comply with the Spam Act 2003 

  • They provide compliant unsubscribe mechanisms 

  • They do not send unsolicited commercial messages 

We do not: 

  • Verify consent 

  • Check Do Not Call registers 

  • Monitor content 

Customer indemnifies us against: 

  • ACMA investigations 

  • Regulatory fines 

  • Spam complaints 

  • Consumer claims 

  • Class actions 

7. Voice Cloning & AI Voice Use 

If Customer uses voice cloning functionality: 

Customer warrants that: 

  • They own or have express written permission to use the voice 

  • The voice does not infringe IP, moral, personality or publicity rights 

  • The voice is not used for deception or fraud 

Customer must not: 

  • Clone public figures without permission 

  • Impersonate unlawfully 

  • Create deceptive deepfakes 

We do not verify ownership. 

We may suspend accounts without notice if misuse is suspected. 

Customer indemnifies us for all voice-related claims. 

8. Acceptable Use 

Customer must not use the Platform: 

  • For unlawful purposes 

  • To impersonate unlawfully 

  • To harass or defraud 

  • To transmit defamatory or offensive material 

  • To interfere with Platform integrity 

We may suspend accounts at our discretion. 

9. High-Risk Industry Limitation 

Customer must not rely on the Platform to provide: 

  • Medical diagnosis 

  • Legal advice 

  • Financial advice 

  • Emergency response services 

Unless independently verified and Customer assumes all risk. 

AI outputs may contain errors. 

10. AI Accuracy & Automation Disclaimer 

Customer acknowledges: 

  • AI outputs may be inaccurate 

  • Transcriptions may contain errors 

  • Automation may fail 

  • Bookings may not process correctly 

Platform is provided “as is”. 

Customer must independently verify outputs. 

11. Fees & Prepaid Billing 

Services are prepaid. 

Customer authorises payment via nominated credit card. 

No refunds for partial billing periods unless required by Australian law. 

If chargeback initiated: 

  • Services may be suspended 

  • Customer is liable for associated fees 

  • We may recover reasonable recovery costs 

12. Intellectual Property 

All Platform IP remains property of Turn Key Receptionist Pty Ltd. 

Customer retains ownership of uploaded data. 

Customer grants us a limited licence to process data for service delivery. 

We may use aggregated, de-identified data for system improvement. 

13. Data Positioning 

Customer acts as Data Controller. 

Company acts as Data Processor. 

Customer bears responsibility for compliance toward callers and recipients. 

14. Security & Cyber Disclaimer 

We implement reasonable safeguards. 

However: 

  • No system is immune from cyberattack 

  • We do not guarantee absolute security 

  • We are not liable for hacking, ransomware, DDoS or third-party breaches beyond our reasonable control 

Customer should maintain independent backups. 

15. Service Availability (SLA Disclaimer) 

We do not guarantee: 

  • Continuous uptime 

  • Error-free operation 

  • Carrier reliability 

  • Uninterrupted telecommunications 

Telecommunications infrastructure is outside our control. 

16. Suspension & Termination 

We may suspend or terminate access for: 

  • Regulatory risk 

  • Suspected unlawful conduct 

  • Non-payment 

  • Reputational risk 

  • Breach of these Terms 

No liability arises from suspension. 

17. Broad Indemnity 

Customer indemnifies and holds harmless: 

  • Turn Key Receptionist Pty Ltd 

  • My Virtual AI 

  • Directors 

  • Employees 

  • Contractors 

From all claims arising from: 

  • Regulatory breaches 

  • Call recording violations 

  • Spam violations 

  • Voice cloning misuse 

  • Defamation claims 

  • Privacy complaints 

  • Misleading conduct 

  • Third-party claims 

  • Class actions 

18. Limitation of Liability 

To the maximum extent permitted by law: 

Our total liability is limited to the lesser of: 

  • Fees paid in the preceding 3 months; OR 

  • Re-supply of services 

We exclude: 

  • Consequential loss 

  • Loss of profit 

  • Loss of goodwill 

  • Regulatory penalties 

  • Business interruption losses 

Nothing excludes non-excludable rights under Australian Consumer Law. 

19. Dispute Resolution & Arbitration 

Disputes must first be addressed through good faith negotiation. 

If unresolved: 

  • Dispute shall be referred to confidential arbitration in New South Wales 

  • Each party bears its own costs 

  • Arbitration decision is final and binding 

Injunctive relief may be sought through courts where necessary. 

20. Class Action Waiver 

Customer agrees to resolve disputes individually. 

Customer waives participation in: 

  • Class actions 

  • Representative proceedings 

  • Group litigation 

21. Force Majeure 

We are not liable for events beyond reasonable control including: 

  • Carrier outages 

  • Cyberattacks 

  • Natural disasters 

  • Government restrictions 

  • Regulatory change 

22. Additional Services Under Turn Key Receptionist 

Turn Key Receptionist Pty Ltd also provides services including: 

  • Live Answering 

  • Virtual Assistants 

  • Live Outbound Calling 

  • Human-operated support services 

Where Customer engages such services, those services are governed by the separate Terms & Conditions published at:

www.turnkeyreceptionist.com.au 

In the event of inconsistency, the service-specific terms apply. 

23. Changes to Terms 

We may update these Terms at any time. 

Continued use constitutes acceptance of revised Terms. 

24. Severability 

If any provision is unenforceable, remaining provisions remain valid. 

25. Governing Law 

These Terms are governed by the laws of New South Wales, Australia.
