We provide AI-powered communication and automation services through: 

  • associated systems and integrations (“Platform”). 

This Privacy Policy explains how we collect, use, disclose and protect personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). 

By using our Platform, you agree to this Privacy Policy. 

2. Our Role – Data Processor vs Data Controller 

2.1 Customers (Businesses Using Our Platform) 

Where a business engages our Platform: 

  • The Customer is the Data Controller. 

  • My Virtual AI acts as a Data Processor. 

The Customer determines: 

  • What data is collected 

  • Why it is collected 

  • How it is used 

We process data on their behalf. 

2.2 Callers & Message Recipients 

If you contact a business that uses My Virtual AI: 

  • We process your information on behalf of that business. 

  • That business is responsible for privacy compliance toward you. 

We recommend contacting the relevant business for privacy enquiries relating to that call. 

3. Information We Collect 

We may collect: 

A. From Customers (Account Holders) 

  • Name 

  • Company name 

  • ABN 

  • Business address 

  • Phone number 

  • Email address 

  • Job title 

  • Login credentials 

  • Billing information 

  • IP address 

  • Usage analytics 

B. From Callers & Recipients (Processed on Behalf of Customers) 

  • Name (if provided) 

  • Phone number 

  • SMS content 

  • Call recordings 

  • Call transcripts 

  • Voicemail recordings 

  • Appointment information 

  • Metadata (timestamps, duration, call routing data) 

C. Technical Data 

  • Browser type 

  • Device information 

  • Operating system 

  • IP address 

  • Cookies and analytics data 

4. Call Recordings & Transcriptions 

Our Platform may record and transcribe calls. 

We do not determine whether recording is lawful in any specific jurisdiction. 

The Customer is solely responsible for: 

  • Determining consent requirements 

  • Providing lawful call recording notices 

  • Complying with surveillance and telecommunications laws 

Recordings and transcripts are processed on behalf of the Customer. 

5. Outbound Calls & SMS Communications 

The Platform may enable outbound dialling and SMS messaging. 

We do not: 

  • Verify recipient consent 

  • Check the Do Not Call Register 

  • Monitor compliance with Spam laws 

Customers are solely responsible for complying with: 

  • Spam Act 2003 (Cth) 

  • Do Not Call Register Act 2006 (Cth) 

  • Australian Consumer Law 

6. Voice Cloning & Audio Data 

If a Customer uploads or generates a voice model: 

  • We process that audio data to provide voice cloning functionality. 

  • We do not verify ownership or consent. 

Customers warrant they have lawful rights to use any submitted voice data. 

Voice data may be processed using artificial intelligence systems. 

7. How We Use Information 

We use personal information to: 

  • Provide and operate the Platform 

  • Process payments 

  • Provide customer support 

  • Improve service quality and AI accuracy 

  • Enhance system performance 

  • Monitor security 

  • Detect misuse or fraud 

  • Comply with legal obligations 

We may use de-identified and aggregated data for analytics and product improvement. 

8. Marketing Communications 

We may send promotional communications to Customers. 

You may opt-out at any time using the unsubscribe link or by contacting us. 

We do not send marketing messages to callers on behalf of Customers unless specifically configured by the Customer. 

9. Payment Information 

Payments are processed via Stripe (or other secure payment gateway). 

We do not store full credit card details. 

Stripe processes payment information in accordance with its own privacy policy and security standards. 

We retain limited transaction data (e.g. amount, date, invoice reference) for billing and accounting purposes. 

10. Disclosure of Information 

We do not sell or rent personal information. 

We may disclose information to: 

  • Cloud hosting providers 

  • Telecommunications carriers 

  • AI technology providers 

  • IT contractors 

  • Payment processors 

  • Professional advisers 

  • Legal or regulatory authorities (where required) 

  • Successors in the event of merger, acquisition or sale of assets 

Service providers are required to implement reasonable safeguards.

By using our Platform, Customers consent to overseas data processing where necessary to provide services.

The Platform uses artificial intelligence and automated systems to:

  • Route communications 

  • Transcribe speech 

  • Book appointments 

These processes may occur without human review. 

Customers are responsible for verifying outputs before relying on them. 

13. Data Security 

We implement reasonable technical and organisational safeguards including: 

  • Access controls 

  • Secure hosting environments 

  • Encryption where appropriate 

However: 

  • No system is completely secure 

  • We cannot guarantee absolute security 

Customers are responsible for protecting login credentials. 

14. Data Retention 

We retain personal information only for as long as necessary to: 

  • Provide services 

  • Meet legal obligations 

  • Fulfil contractual requirements 

  • Resolve disputes 

Customers are responsible for exporting or backing up their data if required. 

We may delete inactive accounts and associated data. 

15. Access, Correction & Deletion 

Individuals may request: 

  • Access to their personal information 

  • Correction of inaccuracies 

  • Deletion (where legally permissible) 

If we are processing information on behalf of a Customer, we may refer the request to that Customer.
